7-24-2020 Residential Foreclosure Update – Administrative Order 157/20

The general stay of foreclosure proceedings in New York directed by various Executive and Administrative orders since mid-March 2020 is finally over! On July 24, 2020, Chief Administrative Judge Marks issued Administrative Order (AO) 157/20, which set forth the Court’s revised procedure for addressing residential foreclosure proceedings. A copy of the Order and Judge Marks issuing Memo regarding the Revised Procedure for Addressing Residential and Commercial Foreclosure Proceedings can be found here/attached. The Order lifts the general stay of foreclosure proceedings in effect since March 16, 2020. New and pending cases may now proceed subject to the provisions of the AO and Banking Law 9-x. 7-27-20 Residential and Commercial Foreclosure Update – Executive Order 202.48

On July 6, 2020, Governor Cuomo issued Executive Order 202.48, which states, “The directive contained in Executive Order 202.28, as extended, that prohibited initiation of a proceeding or enforcement of either an eviction of any residential or commercial tenant, for nonpayment of rent or a foreclosure of any residential or commercial mortgage, for nonpayment of such mortgage, is continued only insofar as it applies to a commercial tenant or commercial mortgagor, as it has been superseded by legislation for a residential tenant, and residential mortgagor, in Chapters 112, 126, and 127 of the Laws of 2020”. Coronavirus Aid, Relief and Economic Security ("CARES") Act The Coronavirus Aid, Relief and Economic Security Act ("CARES" Act") was signed into law on Friday, March 27, 2020. As it pertains to the Mortgage Industry, the following are the highlights of the bill: Definitions: Federally backed mortgage loan includes any loan which is secured by a first or subordinate lien on residential real property, including condominiums and cooperatives, designed principally for the occupancy of from 1-4 families that is insured by the Federal Housing Administrations; insured under section 255 of the National Housing Act, guaranteed under section 184 or 184A of the Housing and Community Development Act of 1992, guaranteed or insured by the Department of Veteran Affairs, guaranteed or insured by the Department of Agriculture, or purchased or securitized by FHLMC or FNMA.
